Below is a copy of the terms and conditions that you will be asked to sign at the beginning of our first session.


Terms and Conditions

“The client(s)” shall be those persons defined in the booking form. In the following terms & conditions “the photographer” shall mean Nik Taylor trading as Pirate Dog Pet Photography. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing. By booking with the photographer you agree to the below Terms and Conditions.


Copyright

All copyright of photographic images belongs to the photographer. You agree not to reproduce, duplicate, copy, with intent to pass on, sell, resell, or exploit any portion of images. Images purchased are for personal use or your own personal business use only.

Artistic Licence – The photographer shall be granted artistic licence in relation to poses photographed, location and editing style and number of images. The photographer’s judgement shall be deemed correct.

Display

The client(s) hereby allow(s) the photographer to display any photographic images covered by this contract and to generally promote the business in advertising, brochures, magazine articles, calendars, websites, photo competitions, sample albums, commercial photography, Stock Photography,..etc.

Use of your images on the web

When uploading your images on the web (Social Media) you will be required to only use the small resolution digital image with the photographer’s logo. You are not permitted to remove the logo or edit the images (changing colours or removing part of the image). High-resolution images (JPEG) without the logo are for print only use. You cannot enter any of your images in a competition (online or otherwise). Prints – When purchasing prints, you cannot scan the print into another print or a digital image. You can purchase the digital images separately.

Equine Session

If you choose, at your own discretion, to ride your horse without a riding hat, you do so entirely at your own risk. The photographer accepts no responsibility for injury or damage caused to horse, rider, property or any individual before, during or after the photoshoot.

Portrait session – General

It is your responsibility to tell the photographer if you feel that the location or situation puts your pet, yourself or family member in danger. If your pet needs to stay on the lead or cannot do certain things (for medical or other reasons) you need to inform the photographer. If your animal is aggressive you also are required to mention it to the photographer to keep everybody safe. The photographer has the right to stop the session if they are concerned about the dog’s welfare, safety or behaviour during the session (no refunds provided).


Personal Accident -

Any directions issued to the clients during the photo shoot are deemed to be at the said person's own risk. The photographer cannot be held responsible for any personal accidents during a photo shoot. It is understood that your pet or pets are your responsibility during the photoshoot.


Payment for portrait session and products

Pet portrait booking fee: Full payment is required at the time of booking, the appointment can be changed up to 10 working days before the portrait session. Booking fees are nontransferable and nonrefundable. No show: If for any reason after receiving your confirmation, you fail to attend your pet portrait appointment (or do not give enough notice), you will lose your full booking fees. You are entitled to a maximum of one appointment change (up to 10 working days before the session) after which you will lose your booking fees. Products: Products are payable during your ordering session. Please note your products will be ordered once the payment has cleared. Once an order has been placed during your ordering session it cannot be cancelled, amended or refunded. Products will be ready to pick up once received from the printer. If you do not wish to order any of the final images your booking fee will be refunded. You need to attend both the Pet portrait session and the ordering session to be entitled to a refund.

Postponement Due To Adverse Weather

If the appointment has to be cancelled due to adverse weather conditions a new, mutually agreed appointment will be made with no additional charge.

Photography session travelling distance

Our fees include travelling expenses anywhere in Devon or Cornwall Locations further away are charged at 50 pence per mile to the location and back home.

Digital Files

When the client purchase digital files the client is responsible to keep them safe and to make duplicates. Any request for additional digital image duplicates from the photographer will incur additional charges. Digital files are provided as JPEG only, edited in my style.

Ordering Session

Products are purchased during the ordering session. You have to make sure all the decision-makers are present. All sales are final. The final decision over your products/images is made during the ordering session as well as payment. During the ordering session you will view the best images from your session (images that do not meet my quality control will be discarded). The number of images provided for viewing will be at the photographer’s discretion. I will charge £50 for a second viewing if you cannot make a decision on the first appointment. If no purchase are made at the ordering appointment, we reserve the right to delete the images.

Cameras of any kind are not permitted at the photoshoot.

Pirate Dog Pet Photography will keep your images on file for at least six months after which your images may be deleted.

If Pirate Dog Pet Photography has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid.

In the event of any situation out of our control (corona virus, storm, fire, etc) we will postpone the sessions and reschedule at a later date.
